OMRI DAILY DIGEST No. 109, 6 June 1995 SLOVAK PRESIDENT ON COLLECTIVE MINORITY RIGHTS. Michal Kovac on 5 June told OSCE High Commissioner for Ethnic Minorities Max van der Stoel that Slovakia will not grant collective rights to ethnic minorities, Narodna Obroda reported the next day. The president noted that Slovakia wants instead to "stabilize and strengthen individual rights." Van der Stoel is on a three-day visit to Slovakia to discuss the Slovak-Hungarian treaty and minority issues. Kovac assured the high commissioner that he would oppose any efforts to forcibly assimilate not only ethnic Hungarians but also Slovaks who live in regions where ethnic Hungarians constitute a majority. Both politicians agreed that the fears of Hungarian minority representatives in Slovakia are occasionally "exaggerated." All rights reserved. SLOVAK PARLIAMENT CHAIRMAN IN BUCHAREST. A Slovak parliamentary delegation headed by Ivan Gasparovic was received by Adrian Nastase, chairman of Romania' s Chamber of Deputies, on 5 June. Radio Bucharest reported that the talks focused on the bilateral treaty recently signed by Slovakia and Hungary. That document includes an explicit reference to Council of Europe Recommendation No. 1201 on ethnic minorities. Gasparovic told his hosts that Slovakia clarified its stand on Hungary' s interpretation of the recommendation in an annex to the treaty. Nastase said Romania might accept a similar statement in its bilateral treaty with Hungary if the articles providing for territorial autonomy and collective rights for minorities were approved. Tuesday, 06 June 1995 Volume 2, Issue 108 SURVEY ------ HUNGARY'S CONSTITUTIONAL CONTROVERSY By David Fink Five years after the fall of communism, Hungary has finally decided to create a new constitution. Members of parliament said while the present constitution basically works, at times it contradicts itself. A committee could be formed as early as this week to work out the basic principles of the new document. In the late 1980s and early 90s Hungary's leaders, new and old, thought lengthy parliamentary debates on a new constitution would slow down the switch to democracy. So, for the past five years, Hungary has functioned with an amended version of its 1949 communist constitution. Hungary's situation isn't unusual. Poland, for example, stll has a communist era constitution. But Hungarian politicians have said the country needs a new document, specifically designed for a democratic state. Free Democrat Peter Hack is chairman of parliament's Constitutional Committee. He said the constitution's priorities must be changed. Right now for example, there's no provision for removing top government officials if they commit crimes. "The whole structure of the constitution is quite strange. The bill of rights chapter is the last chapter, so the man is the last chapter of the constitution and the whole constitution starts with the state." There's broad consensus on the need to change that. Most parties also agree that the new constitution should be more difficult to amend than this one. Right now, it can be changed by a two-thirds majority of parliament, which means the current government can amend the constitution at will, since it controls about 70 percent of the seats in parliament. Other issues are likely to be more contentious. Laszlo Salamon is a member of parliament from the conservative Hungarian Democratic Forum party. He said conservative MPs might propose creating an upper house of parliament with representatives from different groups in society. But Democratic Forum MPs can't even agree among themselves on how it should be organized. "There's no agreement on the the composition of the second chamber, for example on how universities, churches and self governments would be represented there. I don't think there's a chance for a real agreement on this question, of course it doesn't mean we shouldn't try." It'll be difficult to get controversial proposals like that one approved. Each of the six Hungarian parties represented in parliament will have a vote on the new committee creating the constitution and five votes are needed to get a measure included in it. Hungary's most popular opposition party, the Independent Smallholders, might not even participate in the drafting of the constitution. In fact, the Smallholders have created their own constitution, which calls for putting St. Stephen's crown in parliament, stipulates direct election of the president, and gives voters the right to recall members of parliament. Smallholder MP Agnes Maczo is one of the authors of the party's constitution. "In the the last decades and even centuries, the constitution set up a situation in which the elite was separated from the nation, but in this new constitution we want to create a situation in which the elite works for the nation and not foreign interests." So far, other parties have taken a dim view of the Smallholders' proposal. But some outside experts are taking a dim view of the whole idea of creating a new constitution. Gabor Halmai is chief counselor for Hungary's highest judicial body, the Constitutional Court. "As a constitutional lawyer I have to say there is not an urgent need to have a new constitution. I think that the constitution now guarantees a state governed by rule of law." Halmai said the decision to create a new constitution is pure politics. In fact, most politicians admit the new constitution won't be that different from the old one. If Hungary's constitution isn't broken, some say it shouldn't be fixed. V-o-A's Barry Wood reports the deal is likely to be initialed when prime minister Gyula Horn visits Washington this week. Text: The agreement was announced by prime minister Horn as he prepared to leave for Washington and talks with president Clinton and international lenders. The prime minister says the politically difficult austerity program that he introduced in March finally convinced the I-M-F that his government was serious about overcoming Hungary's chronic financial problems. Mr. Horn says the I-M-F stand-by loan will be followed by a longer term lending program that should be approved by the end of the year. Amounts of the planned loans have not been disclosed. Hungary has been seeking I-M-F endorsement for its economic program ever since Mr. Horn's socialist led government came to power a year ago. Last October the head of the I-M-F, Michel Camdessus, visited Budapest where he said Hungary was living beyond its means. He said there would be no further I-M-F lending until the government substantially reduced its budget deficit. In March the Horn government introduced measures that scale back Hungary's generous social welfare programs. In addition, the currency was sharply devalued and a surcharge was levied on most imports. Hungary has a large foreign debt, the servicing of which requires a large share of export earnings. The Hungarian balance of payments are in deficit and inflation remains abover 30 percent (per year). Bankers and the business community want the Horn government to move faster on privatization and further reduce non-essential government spending. The Hungarian economy is growing, but experts say it could grow faster if the government's role in the economy is reduced. The biggest advantage that Hungary has over its neighbors is the huge volume of foreign direct investment it has attracted. The I-M-F accord is an important endorsement of Mr. Horn's economic recovery program. The I-M-F support should also make it easier for Hungary to achieve more advantageous terms on its over 20 billion dollar commercial bank debt. In a news conference Monday sponsored by the U-S Overseas Private Investment Corporation, Mr. Horn, speaking through an interpreter, said that the Hungarian government will soon take steps to eliminate the last vestiges of state socialism, which should make the country more attractive to foreign firms. // Horn act // Naturally, this is not a popular task for the government, but it is not our duty to watch public opinion polls (to see) how popular we (are) but it is our duty to help our country go through this process and to integrate into the community of developed countries. // Horn end act // Over the last five years, almost half of U-S foreign direct investment to the Central European region has gone to Hungary. //Opt// Several U-S firms have been helped by the U-S Overseas Private Investment Corporation, or OPIC, which supports U-S investment abroad through loans and political risk insurance. At the news conference, OPIC announced a 70-million dollar loan guarantee to an American-Hungarian joint venture between Denver-based regional phone giant U-S west and the Hungarian telephone company. The project will offer modern cellular telphone service throughout Hungary. OPIC has already provided 450 million dollars in insurance and financial support for 11 other projects in Hungary. //End opt// At the news conference, Mr. Horn said the national assembly has passed a new act to spur privatization in the country, including key parts of the oil and gas, telecommunication, and electricity sectors. The act also specifies which firms will remain in control of the government. Currently, 60 percent of Hungary's output is produced by the private sector. The government wants to boost this proportion to about 80 percent by 1997, which would complete the privatization process. Mr. Horn said his government had made mistakes in economic reform, but was trying to correct them through a new stabilization program. Combined with a nine percent devaluation of the Hungarian forint which should spur exports, the government's new economic program calls for the reform of the tax system, a tightening of the money supply, a cut of about 15 percent in civil-service staffing, and pay limits on employees in public-sector companies.
